USERRA

Uniformed Services Employment and Reemployment Rights Act

USERRA requires civilian employers to hold jobs for Guard and Reserve members who are called to active duty, maintain their seniority and benefits, and reemploy them when they return, as long as the service member gives advance notice and total military service does not exceed 5 years. Employers cannot discriminate against someone for being in the Guard or Reserve. The Department of Labor enforces USERRA.
